Five Years Later, Smoke-free Ohio Winning

Protect Local Control is an organization dedicated to advocating for the right of local municipalities to regulate tobacco use. Generally, this happens by local ordinance banning smoking in different areas. Sometimes, it happens statewide. In Ohio, we passed our first statewide smoking ban in 2006. Now, five years later, it seems to have been accepted.

How do we know? One example comes from a Lake County health official who tracked complaints about the ban. According to a report at Project Local Control, he gave this data: “Enforcement of the ban started May 3, 2007. In the first year, from May 2007 through April 2008, Lake County received 574 complaints, Kellogg said. From May 2008 through April 2009, it received 230; from May 2009 through April 2010, it received 206; and from May 2010 through April 2011, it received 149 — which amounts to a 74 percent reduction.”

Another argument against the law was based on economics. Opponents said that prohibiting smoking would kill the bar and restaurant business. Again, it’s a win for the no smoking law. Sales data shows that neither bars, nor restaurants were affected by the ban. Furthermore, patrons polled showed that three out of four didn’t alter their behavior based on the no smoking rules.

Also mentioned was a recent survey showing that 73% of Ohio residents thought the law was a good one with only 8% strongly opposed to restricting smoking.

In the loss column may be the push to extend regulations. One bill, SB 27, would make it illegal to smoke in a private motor vehicle when there was a passenger under six years old. This bill has remained stuck in the Transportation Committee for a year. Still, all in all, the law can be said to have won in Ohio.
